BUSINESS, CORPORATE AND

CONTRACT LITIGATION

_______________________________________________

Our forte for several years has been the ability to bring special knowledge and experience to the negotiation, litigation, and when necessary, trial of disputes arising out of business transactions including breach of contract, licensing, unfair competition and product warranty claims.  These have included defending a large suit against the manufacturer of corrugated cardboard box-making machinery, defending one of the largest insurance and reinsurance brokerage firms in the U.S. in federal court litigation caused by the insolvency of a large reinsurance company,  defending a Salt Lake City based computer and software seller in a breach of contract and warranty suit and representation of a national environmental engineering and consulting firm in various actions including prosecution of a trade name infringement lawsuit.

We recently successfully defended a corporate client  in the first suit brought in federal court in this area under the “Employee Polygraph Protection Act” by obtaining a summary judgment, thereby avoiding the risk and expense of a trial for the employer.

During the last two years Our business trial lawyers can read and understand financial statements and the accounting issues that arise from such statements.  We work frequently with some of the top accounting expert witnesses in the country.  We know what it takes to effectively prosecute or defend a complex business lawsuit, and to do it in a manner that is cost efficient for the client.
